Could Kira have won if the story took place in the USA?

As i was watching the show I noticed that a lot of the evidence obtained for the Kira case was taken without warrant, the torture scenes were clearly a violation of the 8th amendment, and the rights of the accused were mostly ignored. If Kira was an American citizen, how could the story have played out differently?
