If the National Guard had taken Michael Myers into custody before Dr. Wynn could break him out of jail would Michael have been given the death penalty or remained locked.up until he died?

Dr. Wynn basically took Michael Myers into custody and broke him out of jail in Halloween 5, possibly giving Michael a hug and words of support, what happens if the state police or National Guard had gotten there first and taken Michael into custody to go to trial based on Dr. Loomis testimony and Michael's willful murders throughout his whole life?

Michael killed a lot of people and slaughtered an entire police department so he would probably face trial and get the death penalty, Loomis would testify against Michael and ensure that he stood trial for his crimes and was aware of his own actions and crimes, unless Michael was locked up and waiting to die eventually from old age in custody.

Michael Myers might face lethal injection and death by firing squad after his trial, certainty he would finally stand trial for his crimes and be questioned in court, not a fun day for him, at least Lonnie might say that Michael spared his life when he bumped into him and didn't kill him.
