Is my case worth pushing? Fraudulent / negligent misrepresentation

Location: Denver metro, Colorado

TL;DR: I have evidence I was deceived into signing a lease due to my leasing staff lying about infestations. This has severely affected my life and I want to hold the management company accountable. I have evidence that the leasing staff knowingly made false promises, as well as evidence of infestations being present way before my move in (2 weeks ago). I want to be reimbursed for damages, and the general toll this has taken on my life.

Moved into an apartment in the Denver metro area 2 weeks and 1 day ago.

Since day 4, I found and have continued to notice a severe cockroach infestation in the apartment. We’re talking adults and babies, in all rooms, at all times of day. They’re in my personal belongings, my food, my bathroom, they’re everywhere.

During the tour, my future roommate and I sat down and asked questions. I specifically asked if there are or ever have been infestations, especially cockroaches. My roommate observed the leasing agent promised me that it has not, and will not be an issue with my apartment. I asked the manager the same question upon signing the lease and was told “I would never let someone move into a place with an issue like that.”

I also have written evidence from my neighbor that this issue HAS in fact been going on since September of last year.

Based on the reassurance from multiple of the leasing staff, I chose to sign the lease and agree to a 13 month contract.

Since day 4, I haven’t been able to sleep or store food properly. All of my belongings are contaminated since they’re everywhere including my room, and my performance at work has drastically suffered due to stress.

Is this worth pushing? As a broke 23 year old, I can’t afford hundreds or thousands of dollars for a case I may or may not win.

I already am set to terminate the lease on Friday after giving them 10 days notice, for breach in warranty of habitability. But I want to know if I have any grounds for fraudulent misrepresentation, or if I’m just wasting my time.
