Wage theft?
Location: Chicago, IL
I work in the “sales” department of a large organization that recently was bought out by a top 10 Fortune 500 company.
Remote work, phones. Hourly wage plus bonus/commission based on monthly sales goals. Sales goals fluctuate month by month with seasonality, volume, etc.
We have a tiered system for sales reps 1-4 which determines sales calls, volume, goals and commission scale.
In January my group had a sales goal of 47. I crushed that and finished with 97. Our tier, collectively, all did well.
On Feb 9th it was verbally communicated to me that bc our group did so well, they were changing our sales goals from 47 to 94. My sales group did too well. Effectively wiping out half my bonus. We have an odd quota/goal structure where commission begins to be paid out prior to hitting the “goal” as the “quota” determines when commission kicks in. The “quota” is always 40 less than goal. So in essence, I was being paid out for 90 over quota but now with the retroactive “goal” increase that moves it to 54, essentially halving my January bonus amount which isn’t paid out until last check of the following month(Feb).
From everything I’ve experienced in 25 years in sales and corporate America - I’ve never seen any organization think this let alone actually do it because our HR/legal dept would jump in with their hair on fire to stop it.
Also, from some googling this seems like textbook wage theft for work already performed.
Penalty in IL is 3x amount owed plus 100% of legal fees. Is this worth pursuing with an attorney?
