[Scotland] I think I'm going to get taxed 45% of my Mum's estate and I don't know what to do
I'm in my early 20's and my Mum died 2 years ago last weekend. I have a younger brother under the age of 16 and we are the sole beneficiary's of my Mum's death in service policy. My Aunt is the executor of my Mum's estate, when she passed we had a solicitor who helped us but slowly his replies would take longer and longer and eventually without informing us he handed my Mum's case over to another solicitor in the same firm.
During this handover the information about my Mum's death in service was not passed along properly this resulted in no communication with my Mum's work until late October last year when my Aunt contacted them, and got the ball rolling. They informed us that a trust must be created for my brother in order for them to pay out any money to anyone, however this trust is still being created and will probably not be created in time for the 2 year 45% tax deadline.
I feel hopeless and I'm not sure what I should do. Any advice or recommendations would be really appreciated
