Need help determining fiscal residence
Hi everyone,
I’m looking for a reality check on a complex tax situation. I’ve done some research (including reading the Host Agreement and Tax Treaty), but I’m getting conflicting "practical" advice vs. "legal" text.
My Profile:
• Status: EU National (French) living in Denmark for a cumulative amount of time > 6 months (I got a 3 months mission that gets extended over and over). I never know when my work will actually finish
• Job: Working for an international organization.
• ID: I have an Administrative CPR (starts with 9000), so I am not registered in the Folkeregister (Civil Registry).
• Tax Card: My salary is exempt from Danish income tax (as per the Host Agreement).
The Problem:
I want to start investing personally (Stocks/ETFs/Crypto) long-term.
• The Legal Text: Seems to say that while my salary is exempt, I am "fully tax liable" (fuldt skattepligtig) for any private income (capital gains, dividends) because I physically live here.
• The "Word on the Street" / HR: HR officially says "we can't advise," but informally mentions that most colleagues report in their home countries (EU). Personally, my saving accounts are still in France. I don’t have a danish account or pay any bill in Denmark as I don’t know how long I would stay (some people stayed more than a year in this situation).
My Questions for the Community:
- Liability: Shoud I report my investments to France or Denmark, I know they have an agreement to avoid double taxation, but determining my fiscal residence is tricky.
Any experiences from someone in a similar situation would be greatly helpful. also let me know if I should post it somewhere else. Thanks!
