[Condo][WA] Lab IIC 54 proof denied, HOA wants field test

Help: Law, CC&Rs, Bylaws, Rules

Bought a condo (1984 wood-frame). HOA requires IIC 54 for flooring. I submitted lab documentation showing my flooring assembly meets IIC 54 in a comparable wood-frame build. Declaration says you need to meet 54 and provide proof — it does NOT explicitly say you must do post-install field acoustic testing.

HOA took ~85 days to review. Kept shifting their reasoning. Finally denied it and now claim the only acceptable proof is an on-site acoustic test.

Here’s the fun part:

  • They admit they have no records of prior acoustic testing enforcement.
  • I know of multiple units with hardwood/LVP and no testing.
  • Downstairs neighbor is also a board member (conflict much?).
  • Every response feels like they’re making it up as they go.

I’m willing to test. But if I have to test, then every hard floor unit should test too. Can’t selectively enforce rules just because someone complained.

At this point it feels arbitrary and targeted. Considering legal options vs just testing and moving on.

Anyone dealt with an HOA suddenly “discovering” a rule and applying it only when convenient?
