Help urgently needed for trial this week
Throwaway account to hide my identity.
I’m in the middle of a long, ugly custody dispute over my young child. My ex earns significantly more than I do and has spent the last two years dragging out proceedings and running up legal fees, seemingly to exhaust me into giving up. I’ve prevailed each time the case has gone before a judge, but I’ve still been pressured into conceding certain rights during mediation because I couldn’t afford to keep pace with the legal costs.
I burned through my savings and finally found a new lawyer who agreed to take the case for less. I had to borrow money from a family friend to pay him, and he knew my financial situation when I hired him. Things seemed okay at first, but now my ex has started doing the same thing again: pushing expensive mediation, showing up and negotiating for hours, then just bailing after multiple sessions.
Because of this, my new lawyer is now demanding more money and has turned hostile. In the last two calls, he’s yelled at me and told me this is my fault for having a child with an abusive man. That was both shocking and devastating, especially since he had been kind and supportive until the fees started piling up. I feel like he thought this would be an easy case and is now taking his frustration out on me.
I have no money left for lawyers, no one else to turn to, and I sometimes have anxiety attacks from the stress. I can’t handle this case on my own without legal support, and I feel completely powerless. It’s terrifying to realize my own lawyer may now be against me.
My daughter is my life. Is there anything I can do at this point, or am I actually at risk of losing my child because I can’t keep up financially?
Update: My lawyer is now telling me I have to agree to a last-minute proposal from my ex or he won’t be able to adequately represent me at trial this week. The proposal reduces the already limited parenting time I have and removes protections my prior lawyer fought for. He also seems uninterested in addressing the past physical, emotional, and financial abuse, despite having documentation and my ex admitting some of it via texts.
He also told me that unless I can come up with an additional $75k, he won’t be able to raise the history of litigation abuse, financial pressure, and patterns of control - even though we’ve been documenting and collecting evidence of this for a long time. He said he also won’t be able to seek legal fees from my ex, and that I’ll likely end up owing him significantly more, plus potentially being on the hook for my ex’s legal fees, because my claims wouldn’t be fully argued at trial.
I feel completely railroaded. I’ve contacted multiple resources - including DV resources - and haven’t been able to get meaningful guidance yet. What are my options here, especially this close to trial?
