Are the 2020 XFL uniform elements not available to use?

When I say this I mean are they trademarked by the original jersey makers, or designs/patterns not being able to use. I only ask because of how the 2023 XFL changed everything, and even now (I won’t lie I miss the Battlehawks helmets and whatnot) it’s still pretty similar if not a bit more iffy?
