F1 spouse re-entering US — filing AOS within 2 weeks after entry risky?
My wife is on an F-1 visa and will be returning to the U.S. around August 20 after summer vacation abroad. We are married, and I’m a U.S. citizen.
We are planning to file I-130 + I-485 (adjustment of status), and I’m wondering about timing. If we submit the application around the first week of September (roughly 10–15 days after she re-enters), could that cause issues related to the “90-day rule” or immigrant intent?
I understand the 90-day rule is a guideline, not a strict law, but I’d like to know real experiences from people who filed soon after an F-1 re-entry. Did you face extra scrutiny or questions at interview?
Trying to decide whether we should file soon after arrival or wait longer to avoid unnecessary risk. Thanks in advance.
