Does Landlord and Tenant Act 1985 Section 11 (re repairs) apply when I've had a string of successive 6-yr tenancies over the last 9 yrs?
Does Landlord and Tenant Act 1985 Section 11 (re repairs) apply when I've had a string of successive 6-yr tenancies over the last 9 yrs?
I have a question re whether Section 11 of Landlord and Tenant Act 1985 requires my landlord to make repairs to damaged (not by neglect/misuse) water pipes in my case. The question focuses on how long I've been here. I might be overthinking this, but would like others' opinions on whether I correctly assume he is liable, just in case he comes back with some legal point I've not thought of.
I've rented here for nine years. During the first eight, twice a year we signed tenancy agreements which specified start and end dates amounting to 6 month tenancies. Last year we signed one for six months with the option to, by mutual agreement - which we've been excerscing since then - to go month to month, which is what we're doing now.
My understanding - which I'd ask you to confirm or correct please is my understanding that Section 11 (1) (a),
https://www.legislation.gov.uk/ukpga/1985/70/section/11/enacted
which requires the landlord to maintain external pipes, does in my case apply.
In all of the agreements, it is stated that Section 11 does apply. That should be enough. Still, biting my lip a bit...
The question only even arises because elsewhere the Act mentions something about terms of seven years or more. I.e.
https://www.legislation.gov.uk/ukpga/1985/70/section/13/enacted
"Section 13 (1): Section 11 (repairing obligations) applies to a lease of a dwelling-house granted on or after 24th October 1961 for a term of less than seven years.
(2) In determining whether a lease is one to which section 11 applies...
(b) a lease which is determinable at the option of the lessor before the expiration of seven years from the commencement of the term shall be treated as a lease for a term of less than seven years, and
(c)a lease (other than a lease to which paragraph (b) applies) shall not be treated as a lease for a term of less than seven years if it confers on the lessee an option for renewal for a term which, together with the original term, amounts to seven years or more."
I believe (2)(b) supports my view, as LL always had the power to determine the lease's length before seven years elapsed; and the conditions of (2)(c) were not met, if these conditions are as described in this passage from Shelter.org:
"A shorter fixed-term agreement that allows the tenant to renew the tenancy so that the total term lasts for more than seven years is not covered by section 11. For example, a three year fixed term tenancy with an option to renew for a further five years." I've never had an option to renew stated in any agreement; except the option in my current agreement to go month to month by mutual agreement.
What do you folks think?
