More on the immigration side of things but if anyone could give me any helpful information that would be great.
I was in a relationship with a girl that had her pr and I was her de facto on a 820. I broke up with her and then got a email to apply for my 801 stage of the visa.
My ex told me she wanted half of everything and she will go ahead with the application, I didn’t want to but it caused crazy arguments non stop so I thought if I wen ahead with it she would be out of my life for good so I did.
She helped me getting all the information and even signed a stat Dec saying we were still together. I went to a visa agent and was honest saying this is the situation what can be done.
I have evidence of me telling the visa agent later on before we applied for the 801 that my ex partner is now in a relationship with someone else. She stated that it is not wise to go forward with the 801 as it’s misleading information, but then 5 days later telling me she spoke with a lawyer and said I was still in a relationship of sorts and it could be argued.
I know this sounds stupid that I agreed to this but I was only 24 at the time and knew nothing about visas and the visa agent I went with was highly recommended so I took her word for everything.
My understanding from what was being lodged was that me and my ex broke up and we weren’t together but didn’t mean were wouldn’t get back together in the future so there was no misleading information.
The visa was eventually refused and the same visa agent told me about family violence route to pr (suffered a lot of abuse and threats while in that relationship)
I went that route and got a lawyer and sent in my reports and that was eventually refused which I thought was strange as I had a lot of evidence about what happened during our relationship.
The tribunal want to know why I gave misleading information on my 801 application 6 years ago before they will even look at my fv case.
It turns out the visa agent lodged my 801 saying we were still in a relationship and immigration were never notified about the break up which I have only found out is the case this week.
They are wanting to kick me out of the country now after living here 10 years.
I know it’s not looking good for me but I honestly just had a massive lack of knowledge about visas at the time of applying for that 801 and relayed on my visa agents professional advice and thought everything I was doing was being an honest reflection of the situation.
Tribunal have said I have two weeks to comment on this misleading information.
I get that I am responsible for what was submitted but the visa agent could have told me to jump off a bridge at the time to get my visa and I would have believed here.
I’m just abit lost as to where to go from here. I honestly didn’t mean to mislead at all but at the same time I understand how this whole situation looks from immigrations point of view.
My lawyers were recommended to me by the same visa agent and I have shown them all the information about her advice and they say it’s not relevant which I am struggling to believe as if I knew then what I know about visas I wouldn’t have went through with what she said.
