UberEATS theft—Class Action Lawsuit, anyone?

I’m furious. I have Uber Eats through Instacart and have had multiple orders in a row where I have paid extra for things like bacon on a burger, then the extra items are not included but I’m told I’m not eligible for a refund. If it’s a dollar or two I generally let it go because it’s nearly impossible to get anyone to respond to issues and no matter what pictures I send they say it isn’t enough evidence.

Last night I hit my limit and I am seriously considering taking legal action over $37 because I am that angry. I ordered food after work yesterday, waited nearly 2 hours, only for the driver to send a picture of someone else’s house, not even on on my street (light beige with red porch, when my house is dark gray with dark gray porch).

I have now spent over 6 hours calling, emailing, reporting in the app, only to receive multiple responses of “the department that reviews this doesn’t have a phone number” and emails saying “you aren’t eligible for a refund”— the f*** I’m not?!!! Anyone with eyes can see that that is NOT my house and I did not receive my order!!

The emails I receive state that if I have additional information to provide, I can respond to the email. But when I respond with pictures and evidence, I get an automated email saying that they can’t receive my email because it’s a different email than the one associated with my account——THE SAME EMAIL ON MY ACCOUNT AND THAT THEY SENT THEIR EMAIL TO.

I have been given the run around and I’m done playing games. You’re not going to steal from me and pay no consequences. I know that I can’t be the only person having their money stolen and if this is happening to other people, does anyone know if there is already a class action lawsuit started? If not, anyone have someone that they recommend to get one started?? Because I work with legal partners regularly in my career and I am absolutely certain that what Uber Eats is doing is illegal and is theft and they owe people money.
