If his tree falls it’s ’act of God’?

I live in the Deep South and recently talked to the person who bought the vacant house next door. He acknowledged he has a dangerous tree looming over my house and that he needed to bring it down. But in the same breath, he told me that if the tree fell on its own, that would be ‘an act of God’ and in our state he would not be responsible for any resulting damage to my house.

I’m getting ready to have a new roof installed and I’m very stressed that he is not ultimately going to take down his tree or accept any responsibility if it falls and damages my house.
