Marriage green card

I-130 & I-485 (Family/Adjustment of status)

Hello everyone,

My partner and I have been together for almost two years. She recently joined the National Guard and will be shipping out soon for Basic Training followed by specialized training, which will keep her away for about seven months.

I entered the United States without inspection when I was two years old. My partner joined the National Guard partly because she wanted to help her parents, who are also undocumented. As our relationship has grown more serious, we have been discussing marriage. We genuinely care about each other and were already planning on getting married, and her parents often ask us about our plans as well.

Since we were planning to marry regardless, she offered to petition for me so I can pursue my green card. We consulted with an attorney who said our case is doable and potentially more straightforward because she will be in the military and can apply for Military Parole in Place (MPIP) on my behalf. I came here without inspection.

My main concern is that we do not currently live together. We plan to get married before she leaves, but because she will be away for seven months during training, we will not be living together during much of the Adjustment of Status (AOS) process.

I’m wondering if anyone has been in a similar situation. Would our chances be negatively affected because we won’t be living together during that period due to her military training?

Any insight would be greatly appreciated. Thank you!
