Learned I am an Executor and Beneficiary of a Will, and suspect my share is being withheld by the other Executor (England)
Throwaway account on the off chance the other Executor uses reddit.
Want to preface this as well by saying I have no experience with Wills, as I'm in the fortunate position that few people have passed, so any level of advise is appreciated.
As per the title, I recently learned that I am one of two Executors and one of two Trustees on a relatives Will who passed away in 2024. The Will was made in 2023. I wasn't made aware of this at the time which I believe is above board (?) But another relative recently provided me a copy of the Will, and I am also a beneficiary to the amount of 25% of their property, which is where my interest comes from.
I recently spoke to the other Executor, who doesn't know I have the Will, and asked offhandedly if she was selling the house (she lives in it) and asked if she did, who does it go to; she said that the Deceased left the entire Estate to her in their Will.
This isnt true, to be specific as I assume the terms are important, me and her are both "Life Interest in Property Trust" with her having the 75% Share and me the 25%.
There is also a clause that allows her to live in the property indefinitely, which is fine and not something I have any interest in contesting, but now I'm aware that she may be selling the house, I just want to ask:
A) is it feasible for her to finalise a sale of the house and keep all of the money, or does it flag up somewhere in the process that I'm due 25%?
B) Is there a way I would have reasonably come into possession of the Will? If I do have to confront the other Executor, due to other relationships I'd prefer to keep things civil and so it would be helpful if I could give a believable reason why I've come into possession of the Will (saying who passed it on would cause more issues)
Aware that obviously more specifics and phrases/ clauses will probably be needed. I can answer with any specifics directly from the Will but just wanted to get the question about there as I'm at a bit of a loss, and at this point in my life 25% of a house sale would be extremely helpful.
