my experience fighting a red light bike ticket in DMV traffic court today
Posting this in case it's useful for someone later:
In July 2023 I got a $190 Disobeyed Traffic Device While Operating Bicycle (red light) ticket in Crown Heights. I plead not guilty hoping the police officer would not show up. My court date was rescheduled twice (2.5 years later).
Here are my defences:
- Ticket says I was operating a blue E-Bike but I submitted receipt proof of using an acoustic Citi Bike
- Leading pedestrian indicator light was on
- There are many e-bike couriers on that road who routinely run the red, and the officer had mistaken me
The officer had very detailed notes about the quality of the road line paintings, flow of traffic, light patterns. He even quoted me, I believe, verbatim. In his statement he explicitly described the LPI walk sign as not lit. Given his explicit comment, I ditched that part of the defence.
I focused on the E-Bike part. The judge asked me if I had more questions for the officer or the court, or wanted to say anything else. I mentioned the piece about the e-bike couriers.
The judge then closed the case by finding me guilty with a $50 fine due to a lack of any other convictions in the preceding 18 month period, and did not impose the surcharge.
PS: I logged on at the 10:30 start time and the case started 30 minutes later. Lasted 5 minutes.
