Dealer not responding to Service Contract cancellation request within 60-day window (Florida) — next steps?
Hi all — looking for some perspective on whether I’m handling this the right way.
I purchased a 2023 Toyota Camry on February 15, 2026 in Florida and financed through Capital One from a Toyota dealership. As part of the retail installment contract, I also purchased:
• Vehicle Service Contract (\~$3,237)
• Additional bundled product (\~$1,746)
On February 19, 2026, I sent a written email to the dealership requesting cancellation of both optional products and asking that any refund be applied directly to my loan principal with Capital One.
No claims have been made under the service contract.
The agreement itself contains a cancellation provision (and appears to require refund within 30 days after notice is received), and I understand Florida Statute 634.121 provides for a full refund if canceled within 60 days and no claims have been used.
I CC’d the finance manager, sales manager, and Executive assistant of office on the cancellation request.
As of now, I have not received written confirmation that the dealership has submitted the cancellation to the administrator (DGV). When I contacted the administrator directly, they advised that cancellation must be initiated by the selling dealer.
My questions:
1. Is email generally sufficient notice of cancellation for a service contract in this situation?
2. Is it normal for dealerships to take several business days just to submit the cancellation to the administrator?
3. If I don’t receive confirmation shortly, is it reasonable to:
• Send a certified cancellation letter to the dealership?
• Contact the lender (Capital One) to log a dispute on the financed add-ons?
• File a complaint with the Florida Department of Financial Services?
4. Has anyone had success getting cancellation processed after involving the lender or manufacturer (Toyota corporate)?
I’m not attempting to unwind the vehicle purchase — just cancel the optional add-ons and have the refund applied to the loan.
Any input from finance managers, dealership staff, or others who’ve gone through this would be appreciated.
Thanks.
