Bonus Question
I am going to file bankruptcy and wondering on timing or when it would be best for me. I think I will be getting a bonus in April and from my understanding if I’m not on a 100% plan, it will be taken as disposable income. I do not want that to happen this year. I would prefer for the trustee to add it to my bankruptcy amount that is owed to creditors and be paid out that way by way of it being in my checking account and just being considered as a non exempt asset. I also know I need to file so that the bonus is not included in my 6 month calculation of income meaning I need to file in April. My question is should I file in March or April? If April, before or after bonus is in my account which I’m thinking will be April 15th. I don’t qualify for a Ch 7 due to income and assets and I don’t think I will be on a 100% plan. Keeping the bonus will allow me to take care of some things around my home and have just a little cushion so I’m not scraping by when I start making bankruptcy payments. Please no judgement…I’m just trying to strategize the best route for me. Was also thinking about maybe settling instead of bankruptcy if there is no way around keeping my bonus this year. I don’t care about subsequent years of it being taken.
