PI Case - 40% Contingency Normal? (OH)
I became aware of a case against a doctor last year. That doctor worked out of 2 facilities; a major hospital and a local private practice. He ended up allegedly causing a death of a patient at his private practice 2 months before I had surgery with him at the major hospital. I suffered major complications, resulting permanent paralysis and several follow up surgeries.
During discovery for the other case, the lawyers were having a difficult time getting the hospital to release information due to HIPAA. The hospital stated the records didn’t exist and couldn’t be given. I had thought I saw that information on my Epic chart and decided to look. Sure enough, it was there!! I took a screenshot and sent it to the plaintiffs attorney, who anonymized it and used it in a brief(Idk what it is called exactly, but it was used as an exhibit).
We remained in contact. I started explaining what happened in my case with the same doctor and how it has affected my life and the attorney agreed to cover my case. He’s advised me on certain follow up care to get, documents to gather, etc before filing. I ended up signing on with them... but the fees seem high. They are 40% contingency regardless of weather the case settles quickly or goes to trial.
Is a 40% flat contingency fee normal? Everywhere I am reading states the amount is typically lower if settlements are reached. I also can't help but think... okay if I am helping them uncover evidence that helps them get a higher verdict in the other case... maybe I should be compensated? Of course I don't want the plaintiff's award, plaintiff suffured a major loss (life of their spouse with several children together), but I suffered a great loss also.
