Grounds for suing a Realestate Agency?

QLD

Hello Ausleagal...

Trying to research online but am finding it hard and conflicting with the situation.

We bought our first home in October going through a smaller local realestate agent. The property was tenanted until this coming June, which for the first home buyers property tax rebate, is a problem. Tenants must be out of the property within 6months of purchase date for us to be eligible for our rebate (over 25k). We knew this going in =, however beggers cannot be choosers in this market.

The problem arises as we would NOT have purchased this home if the selling agent did not tell us multiple times on many occasions that he had spoken with the tenants and they said they were more than willing to move. Foolish I know.

The selling agent said that they would assist us by providing the tenant with a new hom , one of thier other rentals that they manage, win for us, win for tenants.

We asked them to start talking to the tenants about this in late November and looking for properties for tenants. However, the property manager assigned to us had the intention of leaving the company and nevr did ANY of this, not only was no effort made or communicatio, but we did not recieve any of the collected rent until very late Janurary.

By the time we get a new property manager assigned and rent paid we are in Feb.

The tenants have come back angered for reasons I cannot know, judging by the replies it seems the previous property manager has slighted them. And implying thier lease didn't end until November (this leads me to belive the tenants were NEVER asked if they would like to move early int he first place) The tenants demanded 8k worth of reductions and a new rental found for them with no work done on thier end.

The realestate has come back now and said that because the tenants have been "too demanding" that they will never allow them to rent from thier company again.

We have offered more money countless times etc etc, but the tenants will only move if the realestate finds them a new property. We are left in a bind. The realestate refuses to help tenants move, even though tenants are well withing thier right to say no to moving out early, however are being punished for using thier rights as tenants.

The realestate said countless times that they will help find tenants new property, saying this to us and tenants. Now have gone back on their word to both parties.

Is there anythin to do about this? It feels as though it's misrepesentation and breach of fidciary, for them to 100% comfirm to us multiple times the tenant intents to move and that they will aid in doing so, then do a complete turn around and refuse.

Any advice?
