Jodi EWS flat in Mana Skanda

I realised that mana skanda is selling Jodi 3bhk and 3.5 bhk where 1 room + 1bathroom is coming from EWS tagged 1bhks as per Rera. Is this legal? Can they sell this normal buyer? Won't buyer suffer later during OC and then while selling later?
