new apartment smells like sewage!

To make a long story short, we signed a contract on an apartment that smells like sewage, not realizing exactly what it was at the time (I know!). We were in a pinch, with the time on our Airbnb expiring and this place was the right location and space requirements. I expressed my concern to the realtor immediately and he assured me it was the drain pipes— I was skeptical, because it is a deeeep smell, like it’s been there a very long time, but I didn’t want to be the one to preclude us from this place because otherwise it is perfect.

Our agent said we can pay extra to have the pipes cleaned and we did—but we never got verification that it was done, though I’ve asked multiple occasions. We got the keys yesterday, and lo and behold, the place still smells. I wrote yesterday to report that it still smells and we haven’t moved in yet. I’m on my way to Nitori try to cancel our mattress delivery tomorrow!

Our agent called the property manager who was aware of the issue and said to flush the toilet (we’ve done that) and it’s due to heavy rain (it hadn’t been raining when we viewed it and the smell was AWFUL then, too). The are telling us just to move in and see if it goes away, which seems like terrible advice for our agent to be giving us, right? Do we have any legal recourse here? Fwiw, my husband’s name is not right on the contract documents and they told him to sign them all anyway to stay consistent.

His first and middle names are transposed. Can we get out of this? please help!!!
