Anyone navigated divorce after becoming disabled, but before receiving benefits?
My SSDI is pending. I’m in vocational rehab. My husband makes very good money, but after discussing divorce, he says he does not want to pay any maintenance.
Our marriage was only 5 years, but I did work full time the first 2 years, then after Covid, I became completely unable to function.
I had my hearing this month, so expect to hear a decision within a few months, but husband wants to just file and get it over with.
We live in a state that considers all assets and income as marital property, regardless of when it was acquired or whether it is in personal accounts, though neither of us had high income or assets when we married.
I would get a lawyer without question if I weren’t worried that it will just eat into my potential share.
But I’m honestly not sure he is even being completely transparent. If he is, then I would be fine to accept his current offer, which is a larger lump sum in exchange for maintenance. However, I’m not sure any lump sum would be enough for me to feel comfortable giving up maintenance until I know the outcome of my SSDI.
Unfortunately, he is pushing to file and be done asap, which I would be fine with if there weren’t so many uncertainties.
His hurry to get it done is also making me uneasy because why are we rushing such a complex process?
I think he is operating out of self-preservation, but the fact is that he is in a much less precarious financial situation than I am. And if I accept the current offer, whether it is sufficient will be entirely dependent on the outcome of my ssdi and vocational rehab.
Has anyone been through something similar or has advice or insight into things I should be considering?
If I accept the current offer then we will file and continue to be amicable, but I feel if I continue to push or get a lawyer, then he will turn it into a fight that would mean I am on my own sooner. As it is we have said we will continue cohabitating until I can get on my feet.
I don’t think that will be an option if he decides we will just be fighting in mediation or court.
TIA for any advice or guidance.
