Question about Short-Term Rent as a Resident

Housing // Habitatge

Hey everyone,

I’m a Barcelona resident, living with my wife. Due to relationship problems, we agreed I'd move out for 2-6 months while we keep working on it. I’m an autónomo with good income, but I'm hitting three massive walls with the 2026 rental laws:

  1. Short-Term: Agencies are refusing me because I'm a local resident. They say since I'm not a "tourist", a 11-month contract is considered a permanent residence fraud. Is there any way for a local to legally rent a temporada flat?
  2. Long-Term: These have a minimum of 6 months (with a penalty for the remaining years), and are often unfurnished, or...
  3. Local (Commercial): ...they have no cédula. The realtor says I can rent it as an office and just "live" there, and while the tax write-off is tempting, it feels... wrong? How high is the risk of a denuncia from neighbors (assuming I'm quiet and clean)? If I keep my padrón at my old house, is it something people do?

Has anyone else in BCN navigated this? Is the "Local/Office" route the only way to get a nice, furnished place for under a year without being a tourist?

Thanks!
