Help?
I recently financed a 2018 ford focus ST from a used car dealership.
It had 88k miles.
The car was “as is no warranty” which means just that. Well I pull out of the lot and my sister took a video. The car smoked when I put load on the engine. I didn’t notice until later on it started misfiring. Changed the plugs and coil packs. It misfired again. Repeated that process an the misfire never stopped. It was a random misfire every now and then.. 2,000 miles later it blows up. It’s my daily driver so of course I don’t beat on it. I haven’t done any modifications to it, and even had the oil changed early because i don’t trust previous owners oil or when it was changed. So I told the dealership about the issue when it blew up and asked them if they’ve compression an leak down tested it. They claimed they did. But there’s no physical proof of them doing any of it. Long story short, they contacted the bank, an the bank said don’t work on it because “apparently I’ve not made a payment” which I find diabolical considering I have literal proof of payment history. I’ve only had this car 1 month and it’s been blown up for a week. Now they’re wanting to repossess because “I haven’t paid”. So I contact the bank and they verified the no payment. So I gave them info regarding my payments.
(Receipts). They told me to contact the dealership because they weren’t the ones trying to repo. So I contacted them and they’re pointing fingers saying the bank is the ones wanting to repo. They’re pointing fingers at each other and not giving me any actual resolutions… I’m over it, should I take the credit hit and loss and let it go back? I looked at reviews on both bank and car lot and they’re bad reviews… Car lot name is carnation in Knox tn. Finance company is Westlake incorporation. I’ve had it looked at and it was cyl4 low compression they said the pcv failed caused blow by and cracked or washed out my rings or cracked my ringlands. Is there anything legally I can do? Or did I just fuck myself?
