Ex Bailed - QDRO/ED question
My ex has decided to not participate in the rest of the divorce process. He fled the state. He is in contempt, won’t show up for contempt hearing. He’s 50k in arrears for child support, alimony, attorney fees. We still have the final ED hearing. My lawyer is asking for all of his 401k. Ex will not be attending the hearing because he is choosing not to.
I know it’s a toss up how much of the 401k I might get. But hypothetically say that I at least get an additional 50k to cover the back CS SS, can I have two QDROs? One to transfer half of the 401k into my 401k and another to transfer 50k into my bank account? I realize that for tax purposes this will be seen as income but it would help me avoid the 10% early withdrawal penalty. I need it to pay bills. Thank you for your help!
