Seeking Urgent help and advice - Need to travel outside USA on family bereavement
All,
My company had filed by I-140, I-485, I-785 and I-131 in December 2025. The I-140 was applied using premium processing and we completed our biometrics on 8th of January 2026.
Subsequently, an RFE was issued on 3rd February to which my company's lawyers responded to and the status reflected on USCIS tracker on 4th of March (yesterday) .
This morning, my mother passed away enroute to India (from US) at the transit airport in Hong Kong.
I want to travel to Hong Kong asap.
I have a valid L1A visa which expires only in 2028.
I spoke to USCIS and have got an appointment for the 10th of March to process my I-131 on an urgent basis. But that maybe too long of a wait.
I am conflicted by two sets of facts:
-
My attorney says:
" You would need to re-apply for a new parole application upon your return. We noted that you do have an L-1A valid until 02/2/2028, as so its very likely the officer may not move forward with the expedite request as you do have a form of travel. Additionally, given you have valid L-1A status a new advanced parole application."
-
USCIS website says:
"Generally, if you have a pending Form I-485 and you leave the United States without an advance parole document, you will have abandoned your application"
So, my question where I desparately seek your views is - if I travel now outside of USA, will
a) I be able to return with just my valid Visa and no approved AP document?
b) Will this urgent travel have any conseuqnce to my I-140, I-485, I-786 forms? I am ok to re-apply for just the I-131 upon return.
My I-140 is currently not approved and may take more time as I believe the 45 day time for premium processing restarts after RFE response is submitted.
Thank you for your views and responses in advance.
