Mago Splint Cracked

Hi,

I am a 31 year old female. I have TMJ disorder. I started seeing a new dentist late last year (October?) and he diagnosed me with TMJ disorder and ordered a specific X Ray for further analysis. the X Ray cost me about $700 out of pocket and revealed that I have Degenerative Joint Disease particularly on the right jaw socket where the disc is displaced and the joint is ground down. This is consistent with some asymmetry I noticed in my jaw line. I also took a $400 sleep apnea test per his request because my airway is very narrow. I had taken a sleep apnea test through my medical doctor two months prior and did not have sleep apnea, but he wanted me to take a more intensive one so I did. I do not have sleep apnea, just a narrow air passage.

He said treatment would include using a Mago Splint for 3-6 month for diagnostic purposes. He said the splint will be clear and like invisiline and will require adjustments 1-2 times a week. He also suggested masseter and temporal Botox which I did two weeks ago. The cost of the split was $1,100. The Botox was $850. I paid everything out of pocket.

Yesterday morning at 9:00AM I received the splint. It was opaque yellow which was very upsetting, but I felt I had no choice. He did some adjustments, told me to wear it 24/7 including while I eat, and to eat soft foods. I have been following his instructions. This morning I had scrambled eggs, warm soup for lunch, and tonight as I took my first bite of rice and beans I felt a crack on the side of my tongue**. I immediately spit out my food and a jagged chunk of the back of the splint was broken off in my chewed up food. I almost swallowed this.**

I am pretty distressed. It’s been 33 hours since I received the splint. It should not break off like this? And after eating only soft foods. I am not sure I want to continue treatment, but he was insisting that this was the diagnostic step to determine further treatment. I don’t feel really safe getting another splint in case I choke on another shard. I meet with him tomorrow at 7:30AM for an adjustment. I want to ask for a refund for just the splint, but I worry he won’t. I’m miserable and stressed about how much I’ve paid for all of this ($3,000+). How much discomfort and embarrassment I went through wearing this massive, chunky, yellow thing in my mouth in public and at work only for it to break. Do I have grounds to ask for a refund? are there other treatment options I could bring up with my dentist? ☹️

Thank you in advanced!
