Can you be charged if you accidentally steal a wallet and keep it for a week and leave the state?
Location: New Jersey. I want to know if I have a case and if anyone knows whether or not intent to steal seems present. My wallet was stolen at a store parking lot, but I'm not sure if it was an accident or not. This is still ongoing, so I still don't have my wallet. My wallet is coach clutch wristlet and had all my cards, license and cash in it. For some background I lost it on a Tuesday. I put my wallet in my pocket in the car and when I got to the entrance, I knew it was missing. I reported my wallet stolen to the store's customer service after I looked it for 30 minutes around the parking lot and store entrance. I filed a police report for my wallet the next day on Wednesday. There was no wallet returned to the police or the store's customer service. The police looked at the footage and called me on Friday. The police say there is footage of my wallet falling out of my pocket, while exiting my car. The footage captures the faces and license plate of 2 elderly women and a man in the car next to me. One of the elderly women immediately left her car picked up my wallet and they all drove away as soon as I entered the store. The store's loss prevention says they shopped at the store earlier before I came. Because the police had their license, he contacts the elderly woman who owned the car and who possibly took the wallet. The officer said she seemed confused and she spoke broken English. She was able to say she is out of state, and her husband will drop of the wallet Sunday at 4 pm to the police station near the store. I believe she possibly was not in her right mind and thought it was hers, but I also think she wouldn't have returned it if I didn't contact the police to investigate. I vaguely remember a woman in the car next to me watching me leave my car, but that could have been unrelated. I'm suspicious since the elderly woman kept my wallet for nearly 4 days and never reported it stolen. Would they be liable for any charges if they returned it Sunday? I'm conflicted about charging a confused woman, but I am also suspicious. Would it be more effective just to file a complaint? Thoughts?
