Advice on what to do about an accident (Jeepney rear-ended me)
Problem/Goal:
I got rear-ended by a jeep and the operator would not pay according to the settlement. So a criminal case would go and would take months.
Context:
Hi! A few days ago, I got rear-ended by a jeepney in Pasig. I got abrasions and my motorcycle looks aesthetically wrecked, while the jeepney just got a small dent.
It escalated to the point that we got to the Pasig City Police Headquarters and got into a notarized settlement where the operator's daughter and jeepney driver would pay an initial and the final amount within 2 weeks. The driver did not get their license back but the jeepney was released with an undertaking.
Unfortunately the jeepney operator/and her daughter, and driver failed to pay the initial on the stated date and bragged to me that I should just continue the criminal case.
The documents and information that I have so far are:
- Police Report
- Notarized settlement/kasunduan (With names of the operator's daughter and jeepney driver.
- Picture of the Jeepney, and my vehicle
- Picture ng License Plate, Route ng Jeep
- Picture ng License ng Jeepney Driver
- National ID of the operator's daughter
- Estimate of damages ng motor ko
- My hospital bills/temporary medicolegal
The criminal case would result in months, if not, a year, while holding my motorcycle. Should I file a small complaints case in Pasig Court, or should I file a complaint in LTFRB? or what else should I do?
