Eb3 skilled

Hello,

I have an employer who has agreed to sponsor me for eb3 skilled.

Everything seems perfect except for the fact that he doesn’t have any W2 employee working under this company and all the employees are on 1099 contract. Although the job he offered me is W2 job but i am not sure will my perm be approved or not?

Please advise
