1st DUI in Montana- Sentence Being Rescinded

I had my 1st DUI in Montana. I was parked, but the Jeep

was running, so I was still arrested. I hired a lawyer and it was pleaded down to reckless driving. I have had to do 6 months of a SCRAM breath monitor. I have been informed that my sentence is being rescinded because of 9 failed tests.

I have NOT been drinking. I have been doing research and found that people with GERD often fail, which I was not aware of. I had the lapband surgery years ago, and had to have it removed because it fused to my liver and stomach. I am now on lifetime meds for that damage and it causes a lot of issues. I read that GERD can give you almost 100% increase in readings.

Has anyone else experienced this? I go back to court on the 6th, and I am beside myself because I haven’t been drinking! I feel like giving up and losing my career, house, goddaughter, etc.
