Opposing party in my SAPCR case has a disbarred attorney on the filing and I was never served — pretrial is next week!
Location: Texas
I have a pretrial hearing in 5 days for an amended SAPCR that I was never properly served. I only found out about the hearing by calling the clerk's office myself.
When I got a copy of the filing today I noticed an attorney listed as counsel for the opposing party. I looked them up on the Texas State Bar website and they have been disbarred as of February 2026 and filed this sapcr during his suspension period in January 2026.
On top of that:
• I am not listed as a case contact on the filing
• The opposing party has an open child support case with the AG and has been refusing to provide requested documents
• I have been the primary caregiver since my child was born.
I am not represented by an attorney for this case.
My questions are:
-
Is the filing invalid due to the disbarred attorney?
-
Can I request dismissal at the pretrial based on improper service and the disbarred attorney?
-
Should I notify the court ahead of time or present it at the hearing?
-
Any advice on how to handle this pro se?
-
Is there any legal repercussions for the opposing party?
Any help is appreciated.
