Can we claim the lost income from the class action as a tax deduction?

Noticing the scumbags are taxing us on the 1/7 of the proposed lost figure that we are getting made me wonder if we can claim the lost amount as a deduction? I figure if the payout is classed as income, shouldn’t the loss be classed as income also?
