My maternal grandfather passed away recently. Mom's brothers are asking for signed Aadhaar/PAN copies. Given their history, we're suspicious. Need legal guidance.
My grandfather was a very wealthy real estate agent in tier 1 city with hundreds of properties and rental income. He passed away recently. Within days, my mom's brothers asked her for signed Aadhaar and PAN xerox copies, claiming it was for a "family tree." She gave it without thinking. No other documents signed yet.
Some background that makes this suspicious:
My mom's brothers previously got her to sign a blank paper, which turned out to be a GPA transferring property rights — without her knowledge
Years ago under pressure, my mom signed a document relinquishing her claim to a property her father gave back to her, with him saying she was "dead to him" at the time
Most of grandfather's assets were purchased in the names of the brothers' wives during his lifetime.
My mom is the only daughter without allies in that family. Younger sister sides with the brothers.
We believe a will may exist as grandfather verbally indicated he included my mom. However he was ill and unable to speak in his final years, during which the brothers had full access to him.
My mom is emotionally exhausted and hesitant to pursue anything. But we want to understand her legal standing before the brothers complete whatever they're planning.
Questions:
- What can signed Aadhaar/PAN xerox be misused for legally?
- Does the old relinquishment document affect her inheritance rights now?
- How do we find out if a registered will exists?
- What is her standing under Hindu Succession Act as a daughter?
Any guidance appreciated.
TL;DR — Wealthy grandfather just passed. Mom's brothers with a history of forging her signatures are asking for signed ID copies under flimsy pretense. Mom may have been included in will but brothers had years of unsupervised access to him during illness. Need to understand her legal rights before it's too late.
