Separation- can I give my wife the house while staying on the mortgage without triggering due on sale clause WA
Location: WA
I’m going through a legal separation from my wife of 22 yrs. We’ve got a mortgage on good terms, 19 years into a 30 yr. I want to give her the ownership of the house, but I want to stay on the mortgage and finish paying it off. I don’t want to trigger a due on sale clause because I can’t pay the total., so a quit claim deed probably isn’t the play. With the market I don’t want to sell and pay more for less; I really want her to have this asset and I have no intention of fighting. I want to pay this off under the current terms since our kids are high needs and I want them to have a place to live without worrying about rent. Just trying to do the right thing here and keep the assets in my family
I know most would say this is inadvisable. I don’t care; this whole situation is my fault and I want her to have the security she needs. I’m willing to pay for my mistakes. Any advice or guidance is appreciated!
