[NY] Resigning/Bonus Payback

Compensation & Payroll

I work in new york and have been with my company for almost 6 years and around 4.5 of those years have been in a management role. Last year I attempted to quit and was retained with a bonus and pay increase. The bonus was paid of essentially ever 4 months(?) and my

last payout was on january 16th 2026, my contract states the following

“In order to receive this bonus, you must be actively employed by (my company) on the pay-out date. If you resign from the Company

within six (6) months of the Discretionary Bonus payout dates, you will be required to reimburse the Company for the entire

Discretionary Bonus amount ($xx,xxx) “

What Im wondering is if I were to submit my letter of resignation prior to july 16th (ex: july 1st) i would I be required to pay my bonus back if my last day was AFTER the 16th, or do I have to wait until July 16th to even submit my letter of resignation because otherwise they’ll ask me to pay it back?
