S pen not connecting

I recently purchased a new S Pen for my s24 ultra after my old one broke.

I can screen write etc but the pen won't connect to the phone for air actions. Tried resetting the Pen, cleared cache, restarted phone and nothing seems to work.

could the pen be fault? anyone else experience this?
