My dads workers comp case
Hi, I’m hoping to get some answers on if a lawyer is needed or would be worth it.
My dad is a quadriplegic, he fell at work in 1999 and has since required 24/7 care for daily living , especially for preparing meals, putting him to bed.. etc. as he cannot walk or move his hands or arms.
Back in 2021, he was sent a form from workers comp saying that they had sold his case to a managed care provider so they could manage his home health care and correspond with the home health agency. He was told they were dropping his 3-11 shift as he didn’t need it (which is does - this is during meal time) but when he said he wanted to appeal it, he was told “well, the next step is a nursing home” in addition, on the BWC website, it says the catastrophic nurse reached out to his doctor asking for him to write a c9 auth form to remove the 8 hour shift as my brother lives at home. When my dad fell, he was told he would receive 24/7 care for life. We as a family have had to step in, which of course we would do without any questions asked.. but since doing this, they believe he doesn’t need the care for that shift. He has NOT gotten better since his accident. He NEVER will. He has nearly choked, almost bled out, got burned and has thrown up all over himself and had to wait until someone could come help him. Would it be worth it to get a lawyer? He has his original attorney for his case, but not sure if he would need a different one?
