Landscaper damaged my fence
Location: Orange County, Florida.
I am sure this is a very minor issue, but I am trying to decide if I should proceed with any actions.
Yesterday morning, I heard a loud noise coming from my patio area. I went to investigate. I found that a Landscaper, hired by my neighbor, had been clearing weeds and damaged the bottom of my vinyl fence. The fence is actually completely on my property by a few feet, but it does separate my neighbor's backyard, so they would maintain it up to it. The white vinyl fence had damage to the bottom of three of the panels; basically, the bottom is all jagged and ripped up now.
I approached the landscaper, but he refused to provide his insurance information. Initially, he claimed the fence was old and rotted, then he claimed he didn't damage it. I pressed for his insurance information so they could review the matter, but he refused and became quite agitated. I took pictures of the damage, the fence, and his truck with his company information. The fence is over 10 years old, and it is vinyl, but appears fine otherwise. There is no other damage. My biggest complaint is that if he had damaged a single panel and moved on, I would probably not consider anything more than an accident. But, he continued to damage three panels; there was vinyl on the ground where he had been.
Do I have any way to contact his insurance based on his company name? Is this worth small claims court, or am I being petty? Does the age of the fence matter?
