“Do you actually need a lawyer for a personal injury claim in Florida?”
I see this question come up a lot, especially after car accidents or injuries, so I figured I’d break it down in a simple way.
The honest answer is: sometimes yes, sometimes no.
It really depends on how serious your situation is.
When you might not need a lawyer: minor injuries with no long-term treatment, low medical bills, and clear fault where the insurance company is cooperating. In smaller cases, some people are able to handle things directly with insurance.
When you should consider a lawyer: serious injuries involving surgery, long-term treatment, or anything that impacts your ability to work; the insurance company is delaying or offering a low settlement; fault is unclear or you’re being blamed; medical bills and lost wages are adding up; or multiple parties are involved.
Florida follows a comparative fault system, so if you’re found partially responsible, your compensation can be reduced or eliminated depending on the situation. What most people don’t realize is that you’re negotiating against professionals, once you accept a settlement you usually can’t go back, and some injuries, especially from car accidents, don’t show up immediately.
Also, most personal injury cases settle without going to trial, which surprises a lot of people. A simple way to think about it is: if it’s small and straightforward, you might be fine handling it yourself, but if it’s more complex or high value, it’s worth at least talking to a lawyer.
Curious if anyone here in Florida has handled a claim on their own versus using a lawyer and how that turned out.
