Am I eligible for naturalization under §14 StAG (BMI Erlass 30.08.2019) - gender discrimination case from Brazil?

§14 StAG Discretionary naturalization from abroad

Hi everyone, I’d like to get some opinions on whether my case qualifies for discretionary naturalization under §14 StAG based on the BMI decree of August 30, 2019 (gender discrimination in former citizenship law).

My lineage:

∙	Great-great-grandfather - born in Magdeburg, Germany

∙	Great-grandfather (\~1877) - emigrated to Brazil in 1891 (I have the immigration register as proof)

∙	Great-grandfather married in Brazil in 1904 (I have the marriage certificate)

∙	Great-grandmother - born 1906 in Brazil. In 1932, the German consulate in Brazil issued a consular birth certificate (Konsulargeburtsurkunde) for her, meaning Germany officially recognized her as a German citizen

∙	Great-grandmother married a non-German Brazilian in 1926 (I have the marriage certificate). Under the former discriminatory provisions of the RuStAG, she lost her German citizenship upon marrying a foreigner simply because she was a woman

∙	Grandmother - born 1944. Because her mother had already lost German citizenship through the discriminatory marriage rule, my grandmother was born before May 23, 1949 and never acquired German citizenship by birth

∙	Mother - born 1973

∙	Me

Documents I already have:

∙	Great-grandfather’s 1891 immigration register

∙	Great-grandparents’ 1904 marriage certificate

∙	Great-grandmother’s 1906 civil birth certificate

∙	Great-grandmother’s 1932 German consular birth certificate (key document)

∙	Great-grandmother’s 1926 marriage certificate to a non-German

My understanding:

Since my grandmother was born before May 23, 1949, and was excluded from acquiring German citizenship due to the gender-discriminatory loss her mother suffered, she and her descendants don’t fall under §5 StAG (which covers those born after 23.05.1949). However, the BMI decree of 30.08.2019 explicitly opened the path for these pre-1949 cases and their descendants through §14 StAG, establishing that the gender discrimination itself constitutes public interest (Ermessensreduzierung auf Null).

My concerns:

1.	My great-grandfather emigrated in 1891, before the RuStAG came into effect on 01.01.1914. I’ve read that the BVA uses 1914 as an informal cutoff based on administrative practice, but the 1932 consular certificate proves Germany recognized my great-grandmother as a citizen well after 1914. Does this override the cutoff concern?

2.	I’m a 4th/5th generation descendant living in Brazil with no direct ties to Germany. Given the BMI decree, do I still need to demonstrate strong ties, or is the gender discrimination argument sufficient?

Has anyone here gone through this specific pathway (§14 StAG + BMI Erlass 2019 for pre-1949 gender discrimination cases)? How long did it take? Any advice?

Thanks in advance!
