204C

Advice/Help needed

I’m looking to hear from people who’ve actually been in a similar situation, because when I tried posting before, I got a lot of judgment without people really understanding the full story.

I went through two marriage interviews with my ex spouse. In both, we were separated and asked very detailed personal questions. Some answers didn’t match perfectly (like where we kept our toothbrush) but the relationship was real. We were together for about 4 years and built a real life together.

Despite that, USCIS focused on the inconsistencies and denied the case, even referencing 204(c), basically saying they don’t believe the marriage was bona fide.

The reality is very different. My ex wife struggled with drug addiction, and the relationship was emotionally and financially abusive. She took advantage of the fact that she was a U.S. citizen and I was an immigrant. What USCIS saw as “inconsistencies” was, in many ways, the result of a toxic and unstable relationship not fraud.

We submitted a lot of strong evidence showing the marriage was completely real, including:

•	Photos throughout the relationship and wedding

•	Joint leases and shared living arrangements

•	Joint accounts and financial records

•	Insurance, bills, travel records

•	Messages and communication history

•	Notarized affidavits from both sides of the family and people who knew us as a real couple

After the relationship ended, I filed a VAWA case based on emotional/psychological abuse (not physical). I included a detailed personal affidavit, supporting evidence, and a psychological evaluation.

It shouldn’t surprise anyone that USCIS makes mistakes all the time.

Now I’m waiting and trying to understand where I realistically stand, especially with the 204(c) issue.

Has anyone here actually been approved in a similar situation?

Especially with:

•	prior interview denial

•	204(c) mentioned

•	VAWA based on non-physical abuse

Would really appreciate hearing real experiences.
