Israel's Death Penalty and Destiny's Response

Political News/Discussion

Following Israel's new Death Penalty law being passed a few days ago a chatter joined in and confronted Destiny on the matter, ultimately asking if this law isn't 'evil' enough what is and what would move his opinion on Israel as a whole.

Seeing many comments on Youtube which seem to support the chatter and bash Destiny for his supposed lack of condemnation. I want to use this post first to dive into this law, what it says, what it will probably look like and its political context. Secondly the way Destiny responded and why to me at least its not weird that this would not meaningfully move him.

Disclaimer:
I am Israeli, born and raised. I will do my best in this post to separate fact from opinion while giving a local's interpretation of the matter.

The History:
Before looking at this new law I recommend you read about the history of the death penalty in Israel - Here is a nice summery from an Israeli newspaper. TL;DR - The death penalty existed and still does in Israel though properly its only been invoked once, It is possible today to issue the death penalty to terrorists but its not done both due to public opinion and legal complexities of Death Penalties.

What it says:
The law separates military and Israeli court, both allow for the death penalty under this new law but differ in the requirements and process.
In military court - This would apply to non Israeli citizens living in the West Bank - Individuals who perform acts of terror which lead to the loss of life will be issued the death penalty (unless the court determines that there are special circumstances that should commute the sentence to life in prison). This sentence cannot be lightened but it may be appealed.
In Israeli court - This would apply to Israeli citizens at large - Individuals convicted of terror related murder committed with the intent to eradicate the State of Israel would be sentenced to death or life imprisonment.

What will happen:
Knowing what will happen is impossible but here are the current ongoing processes which will prevent this law to take affect.
The Israeli High Court of Justice (Bagatz) has been issued a petition the same day the law was passed and has agreed to hear the petition, it has given the government until the 24th of April to issue a response, currently only for the decision if an interim order should be put in place.
If an interim order is given the deliberations could take months or years before this law is either approved or denied by the court.

The Politics (Opinion):
This law is very political and it comes to serve a clear goal, whether it goes through the courts or not it will have been a win to this governments base. Its important to understand that Israel is moving into an election season soon (November) and that the current government is down in the polls by a lot making it clear they will not be able to hold power if things stay as they are.
If it goes though - a clear win for the far right parties showing that they are ruthless to terrorist (in particular the Palestinian kind). Any future government looking to reform this law will be painted as supporting terrorists.
If it doesn't - I personally think this is the likely and expected outcome, this government has been working to undermine the High Court of Justice in many ways and passing a law such as this with the expectation that it will be thrown out gives them another political point against the courts "The unelected judges are helping the terrorists against the people's mandate".

Destiny's Response:
I'm not going to try and tell you what Destiny thinks but why its not surprising to me that this news even taken at face value would not move him into the 'Israel Evil' camp.

  1. Destiny has been to Israel, he has experienced the county and met the people including prominent political figures. I point this out because this experience is going to hold a lot more weight for people then faceless articles.
  2. Israel is a democratic, secular and western country. You might not like what Israel decides to do as a country and you will definitely find individuals you disagree with or even detest but the democratic system has the ability to recover and the checks and balances to stop extreme acts (probably this law too).
  3. The labeling of 'evil' is weird in the context of a country especially a democratic one. Labeling Israel as 'evil' as a democratic state means that you label most Israelis as 'evil' people and from here you can go pretty far. Calling the current government of individuals 'evil' is fine.

Hypocrisy and My Take:
Before giving my opinion, if the last block did not convince you I want to show the hypocrisy in defining Israel as evil and claiming all ties should be cut. Donald Trump, acting as POTUS has done already many 'evil' acts which I think are easily worse than this law. If that is true the chatter being a Canadian should at once call for Canada to condemn the US as 'evil' and cut all ties with it, otherwise what other acts is the chatter waiting for? When will he be convinced that the US is 'evil'?
My Take - Morally I don't oppose the death penalty but in practice I don't think its legally worth it. That being said I think this law is bad its clearly not applying the law equally and also gives the death penalty to military court which I definitely do not support. I am not a fan of this government and their continuous attacks on the courts and democracy.
