Have a job offer that got rescinded
Location: North Carolina. Hello! I applied for a maintenance technician position at a very reputable company and got a call back, had to take a 150 question exam as well as complete some hands on stuff in front of their maintenance supervisors as a part of my interview process. They reached back out and offered me a position there and I did my onboarding paperwork and went to go do my drug test/physical and during the physical, the nurse did a “hearing” test where she stood about 8 feet away from me and turned around and whispered words in which I told her I was not able to hear her to recall the words she was whispering for the “test”. She passed me on the physical with the stipulation of me scheduling an appointment with a hearing specialist and getting a thorough evaluation from them within 60 days of my hire date or the pass would be void. I received a call from HR and they asked what happened because they couldn’t view the notes left from the nurse, I told them what the nurse said about the stipulation and that I had a copy of the paperwork saying that I PASSED and could drive up there to show the paperwork had already scheduled an appointment with a specialist. The HR lady said she would call me back within a few days. She called me on Friday of last week and said they would not be moving forward with me because of me being a safety liability if I couldn’t pass a hearing test and I asked her if she noticed anything about my hearing in our communications (phone calls) and she admitted that she saw nothing implying that I was having trouble communicating with her or hearing her and I then confirmed that they wanted maintenance to also wear hearing protection on the floor in which she said yes. She then recommended I call “hireright” and see what they recommend I do next which is the company that processed the background check and physical for them and when I called them, they said to ask her if she’ll let me get a second physical for a second opinion but I can’t call her until tomorrow. I’m kind of bummed out and idk what to do exactly and I was wondering if this had any legal grounds for me to stand on as it kind of feels like discrimination, especially considering in the offer letter it says “Your tentative start date is 04/20/2026 pending successful completion of pre-employment screening.” And I didn’t FAIL the physical or drug test. Happy to answer any questions to give insight where needed
