Tenants rights: Do I Have the Right to Use My Rented Bedroom Normally?
I’m reaching out to get perspective on a situation in my current rental and to better understand my rights as a tenant.
I began a 1.5 year lease 6 months ago for a four-bedroom house with two other roommates. I rent the master bedroom with a private bathroom and pay the highest portion of the rent ($900). One of the other roommates has a standard bedroom as well as an additional bedroom that she uses as a dedicated office and recording space ($800). The third roommate pays the least and is not directly involved in this issue ($700).
When we moved in, I was aware the $800 roommate was an actress and recorded audiobooks, but she did not have a full-time job at the time. Her office/recording space shares a wall with my bedroom. After moving in, she started a full-time remote job and regularly asks for quiet during the day. She began doing her recording in the evenings and more of them (approx 20 hrs/week). What was initially occasional “can you turn your tv down” has become significantly more frequent — now between 3-5 times per week, during the evenings (6:30-11pm) and a weekend afternoon (Sat or Sun 2:30-9pm) which are the main times that I am home. She informs me when she is recording rather than asking, and during those times expects me to limit TV use, has asked me to leave my room for phone calls, stop in the middle of tasks, and talk quieter because she is “distracted”.
I requested an in-person conversation multiple times to find a compromise so she could continue recording while I could still use my room normally, which was met with resistance and hostility. When we eventually had the conversation, she accused me of being controlling and also stated, “I’ll pay more.” There were no clear parameters set during our meeting, but I was willing to compromise for that week because I knew she had a deadline. I made it clear, however, that this level of recording cannot continue so frequently and that I would like her consent in advance for future sessions. Less than a week later, I receive a text saying she needs 3 weekday evenings to meet her deadline. I followed up to discuss a rent adjustment, at which point she reacted very strongly, stating she was “livid” and “pissed,” and said, “yeah, that wasn’t an actual offer, I can’t pay more in rent.”
In addition, there have been multiple incidents of her screaming, crying loudly, and yelling so loudly it can be heard outside the home. She has also committed domestic assault against her boyfriend, both inside the home and in public in the neighborhood, on multiple occasions. I have requested boundaries that there should be no screaming in the house and that nothing illegal can occur on the premises or neighborhood.
From my perspective, I feel that I am being asked to significantly adjust the use of my own rented personal space (bedroom) on an ongoing basis, without any agreement or compensation. We never agreed to a recording arrangement verbally or written, although she says I knew what her job was before we moved in. I’ve tried to be accommodating, but the frequency and expectations have made the situation increasingly difficult.
I would appreciate your guidance on the following:
• Do I have a right to use my bedroom normally (including reasonable noise like TV or phone calls), even if it interferes with her recording or work-from-home needs?
• Does this situation potentially interfere with my right to “quiet enjoyment” of the property?
• Am I within reason to request a rent adjustment under these circumstances?
• What options do I have if this situation continues (e.g., lease termination, reassignment, etc.)?
I’m also trying to understand objectively whether my expectations are reasonable in a shared living situation, or if I may be overlooking something.
Thank you in advance for your time and guidance! Any thoughts, advice, and insight would be greatly appreciated!
