Need urgent legal guidance (Attempt to murder case, juvenile claim, Sessions Court stage).

Urgent

I am seeking advice regarding a serious criminal case involving an attack on my mother last year.

A man from our locality attacked my mother with a knife in a life-threatening incident. There is strong evidence including CCTV footage clearly showing him grabbing and assaulting her, recovery of the weapon, and blood-stained clothes. My mother survived, but it was a traumatic and extremely serious attack.

The accused claimed to be a minor (around 17 years 10 months at the time). However:

  1. There is no birth certificate

  2. The school certificate appears tampered (visible overwriting/cuts)

  3. We strongly suspect manipulation of records

Despite this, the court accepted these documents, rejected our request for ossification test, and granted him bail. He is currently out and living nearby.

We have now moved from lower court to Sessions Court.

Our lawyer has not been proactive, and the case has mostly seen repeated adjournments. My father, who initially filed the case, is now extremely exhausted and losing hope due to delays. I understand his situation, but I want to continue pursuing this case properly and ensure it does not weaken or close.

There are also statements made by the accused to the police indicating serious intent behind the attack.

I am genuinely struggling to understand how, in a case involving such a violent attack with strong evidence, the accused is out on bail. This has been extremely distressing for me and my family.

I am feeling mentally overwhelmed and want to handle this legally and correctly without making any impulsive decisions.

I need guidance on:

  1. Can we still request ossification test or independent age verification at the Sessions Court stage?

  2. How can we legally challenge a possibly forged school certificate and manipulated records?

  3. Can bail be cancelled on grounds of misrepresentation or fraud?

  4. Can we approach High Court directly at this stage?

  5. As a family member of the victim, can I actively take over coordination of the case if my father steps back?

  6. What immediate steps should be taken to ensure the case remains strong and does not weaken due to delays?

Any practical guidance on next steps or legal strategy would be deeply appreciated. I want to pursue this properly and ensure justice.

Thank you.
