question about policies

for GPEW, policy CJ382 suggests that women would instead be subject to committee service rather than prison for certain crimes. RR531 is about gender self ID regardless of medical documentation. to clarify these are both policies i AGREE with! i’m not transphobic in any way and this doesn’t not come from a place of transphobia- but doesn’t this create a loophole where violent male offenders can avoid prison time by claiming that they are trans? now i’m assuming that CJ382 doesn’t apply to violent crimes but i’m unable to find a policy suggesting that it doesn’t since i’m not a member and can’t access all their policies. can anybody clarify this for me with evidence?
