AIO: Photographer posted my 1 year old sons photo to a Facebook group of 40k+ people

Contracts

Location: Michigan

Hello Reddit. My wife and I had photos taken of our son back in January for his first birthday. The photographer did an amazing job, and she’s the same person who did our wedding photos. My wife and I are friends with her on Facebook, so we see her posts pretty regularly.

Today I was scrolling and saw she made a post advertising one-year photo sessions (just text, no pictures). A little later, I came across that same post shared in a large Facebook group, that has 40.5k people in it, except this time she used a photo of our son.

She never asked us for permission to use his image in that way. I checked our contract, and it basically says she owns the copyright to the photos and that we can use them for personal use, but it doesn’t clearly say anything (at least from what I can tell) about her using the photos for advertising or promotional purposes.

What makes it feel a bit off to me is that she didn’t use his photo on her main page, but did use it in this large group that we’re not even part of. It makes me wonder if she assumed we wouldn’t see it.

My wife is pretty upset about it, and I feel weird about it too.

Am I overreacting about this? Is this normal for photographers to do? Should we say something to her, or just let it go?

Thank you for your help!
